The Georgia Child Support Guidelines are based upon expenditures for a child in intact households. The Court may order a deviation from the Presumptive Amount of Child Support when special circumstances make the Presumptive Amount of Child Support excessive or inadequate due to extended parenting time or when the child resides with both parents equally.
If the Court or the jury determines that a parenting time Deviation is applicable, then such Deviation shall be applied to the Noncustodial Parent's Basic Child Support Obligation. If a parent brings a claim for adjustments based off of the amount of parenting time dedicated by the two parents, this action is solely between the custodial parent and the noncustodial parent. No other third parties, such as grandparents or any governmental agency, are relevant to a child support payment award request based on parenting time grounds.
